1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your use of Villa Monticello’s services and facilities. By making a reservation, staying at our hotel, or using our services, you agree to be bound by these Terms.

2. RESERVATIONS AND BOOKINGS

2.1 Making a Reservation

  • Reservations can be made through our website (www.villamonticello.com), phone, email, or authorized booking platforms
  • A valid credit card is required to guarantee your reservation
  • All reservations are subject to availability
  • By making a reservation, you confirm that you are at least 18 years of age and have the authority to enter into these Terms

2.2 Reservation Confirmation

  • You will receive a confirmation email once your reservation is processed
  • Please review your confirmation carefully and notify us immediately of any errors
  • We are not responsible for reservations made through unauthorized third parties

2.3 Rates and Packages

  • All rates are quoted in US Dollars (USD) unless otherwise stated
  • Rates are per suite, per night, and are subject to applicable taxes
  • Rates may vary based on dates, room type, and availability
  • Special packages may have specific terms and restrictions

3. PAYMENT

3.1 Payment Methods

We accept:

  • Major credit cards (Visa, Mastercard, American Express)
  • Bank transfers
  • Cash (subject to availability and local regulations)
  • Mobile money (where available)

3.2 Payment Terms

  • **Pre-Paid Bookings:** Full payment is required at the time of booking
  • **Flexible Bookings:** Payment may be made at check-in or as specified in your booking confirmation
  • Your credit card will be charged in accordance with your selected payment option
  • All charges are in US Dollars unless otherwise specified

3.3 Taxes and Fees

  • All rates are exclusive of applicable taxes (including VAT, tourism levy, and any other local taxes)
  • Current taxes will be added to your final bill
  • Additional fees may apply for extra services (spa, dining, events, etc.)

4. CHECK-IN AND CHECK-OUT

4.1 Check-In

  • Standard check-in time: **2:00 PM**
  • Early check-in is subject to availability and may incur additional charges
  • Valid government-issued photo identification (passport or national ID) is required at check-in
  • The credit card used for booking may be required at check-in for verification

4.2 Check-Out

  • Standard check-out time: **12:00 PM (noon)**
  • Late check-out is subject to availability and may incur additional charges:
  • Until 5:00 PM: 50% of the nightly rate
  • After 5:00 PM: Full nightly rate
  • Please settle all outstanding charges before departure

4.3 Luggage Storage

  • Complimentary luggage storage is available before check-in and after check-out
  • We are not responsible for loss or damage to stored items

5. CANCELLATION AND MODIFICATION POLICY

5.1 Standard Cancellation Policy

  • **Flexible Bookings:**
  • Free cancellation up to 48 hours before arrival
  • Cancellations within 48 hours of arrival: charge of one night’s accommodation
  • No-shows: charge of full reservation amount
  • **Pre-Paid Bookings:**
  • Non-refundable
  • No modifications or cancellations permitted
  • No-shows: no refund

5.2 Special Rates and Packages

  • Special promotional rates may have different cancellation policies
  • Please refer to your booking confirmation for specific terms

5.3 How to Cancel or Modify

  • Cancellations and modifications must be made through the same channel as your original booking

5.4 Force Majeure

  • In cases of force majeure (natural disasters, pandemics, civil unrest, etc.), we will work with you to reschedule or provide alternative arrangements
  • Refunds in force majeure situations are at the hotel’s discretion

6. GUEST RESPONSIBILITIES

6.1 Guest Conduct

Guests must:

  • Treat hotel property, staff, and other guests with respect
  • Comply with all hotel policies and Ghanaian laws
  • Not engage in illegal activities on hotel premises
  • Not cause disturbance to other guests
  • Be responsible for the conduct of their visitors

6.2 Prohibited Activities

The following are strictly prohibited:

  • Smoking in non-designated areas (violations may incur cleaning fees of $500 in Suites)
  • Weapons or firearms on hotel premises
  • Illegal drugs or substances
  • Prostitution or illegal activities
  • Pets (strictly not allowed)
  • Excessive noise or disorderly conduct
  • Unauthorized commercial activities or filming

6.3 Room Capacity

  • Maximum occupancy is as stated for each suite type
  • Additional guests beyond stated capacity are not permitted without prior arrangement
  • Extra person charges may apply

7. DAMAGE AND LIABILITY

7.1 Guest Liability

  • Guests are responsible for any damage to hotel property caused by themselves or their visitors
  • Repair or replacement costs will be charged to your account
  • The hotel reserves the right to charge your credit card for damages discovered after checkout

7.2 Hotel Liability

  • The hotel is not liable for loss, theft, or damage to guests’ personal property
  • We recommend using the in-room safe for valuables
  • The hotel is not responsible for items left in guest rooms after checkout
  • Our liability is limited to the extent permitted by Ghanaian law

7.3 Insurance

  • We strongly recommend guests obtain travel insurance to cover cancellations, medical emergencies, and loss of personal property

8. CHILDREN

  • Children of all ages are welcome at Villa Monticello
  • Children under 12 years may stay free when using existing bedding
  • Additional charges apply for extra beds or amenities
  • Parents/guardians are responsible for supervising children at all times

9. SERVICES AND AMENITIES

9.1 Hotel Services

Our services include:

  • 16 luxury suites
  • The Brasserie (restaurant and bar)
  • Room Service
  • Koncierge services
  • Spa treatments
  • Banqueting and event facilities
  • Complimentary Wi-Fi

9.2 Service Availability

  • All services are subject to availability
  • The hotel reserves the right to modify, suspend, or discontinue any service
  • Operating hours may vary and are subject to change
  • Advanced booking is recommended for restaurants, spa, and events

9.3 Third-Party Services

  • Some services (tours, transportation) may be provided by third parties through our Koncierge
  • The hotel is not liable for services provided by third parties
  • Separate terms and conditions may apply to third-party services

10. EVENTS AND BANQUETING

10.1 Event Bookings

  • All events require a signed contract and deposit
  • Specific event terms will be outlined in your event agreement
  • Minimum guarantees and cancellation policies apply
  • Final guest counts must be provided 72 hours in advance

10.2 Outside Catering

  • Outside catering services are available with advance arrangement
  • Additional terms and fees apply

11. MEMBERS CLUB

  • Villa Monticello Members Club has separate membership terms and conditions
  • Members receive exclusive benefits and privileges
  • Membership fees are non-refundable
  • The hotel reserves the right to modify membership benefits

12. HEALTH AND SAFETY

12.1 Guest Health

  • Guests must inform the hotel of any medical conditions that may require special assistance
  • The hotel is not responsible for providing medical care
  • Emergency medical services will be contacted if necessary

13. PRIVACY AND DATA PROTECTION

  • Your personal information is handled in accordance with our Privacy Policy
  • By making a reservation, you consent to our collection and use of your personal data

14. INTELLECTUAL PROPERTY

14.1 Hotel Property

  • All content on our website and materials (logos, images, text) are owned by Villa Monticello
  • Unauthorized use, reproduction, or distribution is prohibited

14.2 Photography and Filming

  • Commercial photography or filming requires prior written permission
  • The hotel may use photographs taken on property for promotional purposes
  • Guests who do not wish to be photographed should inform staff

15. TERMINATION OF STAY

The hotel reserves the right to terminate your stay without refund if:

  • You violate these Terms and Conditions
  • You engage in illegal activities
  • You cause disturbance to other guests or staff
  • You damage hotel property
  • You fail to pay charges when due
  • You pose a safety or security risk

16. COMPLAINTS AND DISPUTES

16.1 Complaints

  • We strive to provide excellent service and welcome feedback
  • Please report any issues immediately to reception or management
  • We will make every effort to resolve complaints during your stay

16.2 Dispute Resolution

  • Any disputes will first be attempted to be resolved through good faith negotiations
  • If unresolved, disputes shall be subject to Ghanaian law

17. LIMITATIONS AND DISCLAIMERS

17.1 Service Interruptions

  • The hotel is not liable for service interruptions due to:
  • Utility failures (electricity, water, internet)
  • Natural disasters or extreme weather
  • Government actions or civil unrest
  • Circumstances beyond our control

17.2 Third-Party Websites and Bookings

  • We are not responsible for the accuracy of information on third-party booking sites
  • Terms and conditions of third-party platforms apply to bookings made through them

18. MODIFICATION OF TERMS

  • Villa Monticello reserves the right to modify these Terms at any time
  • Changes will be posted on our website with a new “Last Updated” date
  • Your continued use of our services after changes constitutes acceptance of the new Terms
  • For existing reservations, the Terms in effect at the time of booking apply

19. SEVERABILITY

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect

20. ENTIRE AGREEMENT

  • These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Villa Monticello
  • These Terms supersede all prior agreements or understandings

21. GOVERNING LAW

  • These Terms are governed by the laws of Ghana
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of Accra, Ghana
